UAE Employment Law | UAE Labour Law | Immigration Law 2018 Updated

Employment Law, Labour Law, Immigration Law Updated 2018.


Understanding your employee rights is a very important part of living and working in the World. Working in UAE you have to know the Employment Law, Labour Law and Immigration Law.
Different Law apply to the employees of the public and private sectors and free zones.

Employment Law for Public sector:
Public sector employee are governed by the Federal Law No.11 as amended.Ministries and federal authorities who's law provide that they will have exclusive job regulations are exempted from the above Decree within the limits of its conditions.

Employment Law for Private sector:
Federal Law No.8(Labour Law) Deals with labour rights of workers in Private sector.This Law deals with matters of sick leave, working hours, public holidays, marriage leave, Saftey standards and few other matters.


As per the Article No.3 of the Law, it is applied on all the workers in UAE, both UAE National and foreigners. As amended later the condition doesn't apply on those working in federal government, local goverment departments armed forces, public entities, local projects,policies, security, domestic servants farms.
Note: Ministry of Human Resources and Emiratisation maintains the Labour right oversee the employee-employer relation.

As per UAE Labour Law some key Provisions

Working Hours:

The Average working hours for those working in private sector are 8 hours per day which can be increased to 9 hours/day with permission of MOHRE.

Official Leaves and Vacations:

Friday is the official weekend for all workers except for daily workers. according to UAE Employment Law Employees are entitled for paid leave on the following public holidays:
    Islamic New year - 1 day
    Gregorian New Year - 1 day
    Eid Al Fitr - 2 days
    Eid Al Adha - 2 days
    Prophet Mohammed(PBUH) birthday - 1 day
    Isra and Miraj Day - 1 day
    Martyr's Day - 1 day
    UAE National Day - 1 day

Employees are allow to an annual leave of 30 days, if they have completed one year of service.

WPS:

Wages Protection System. The Salaries will be transferred to the accounts of employees in banks which are authorised by Central Bank of UAE.

Safety at Work Place:

Articles 91 to 101 of the UAE Labour Law specify the employee safety and Health care.Employers should keep a first aid box at work sites having medicines and bandages in it.

As per UAE Employment Law Employers should give proper tools and equipment for workers so that they are safe from risks like getting fired or any other troublesome condition.


Prohibited alcohol at work places:

No employer may bring nor allowed others to bring alcoholic drinks on work places.

Minimum Salary:

There is no minimum Salary mentioned in UAE Labour Law, However they broadly mentions that salaries must cover the basic need of the employees.

Free Zones Employees:

By UAE Employment Law Free zone workers aren't usually governed Under UAE Labour Law.Every free zones authority has its own law of employment. Employees have a contract with such free zone authorities and are sponsored by them instead of any employer.

Domestic Workers:

In September 2017 HH Sheikh Khalifa Bin Zayed Al Nahyan, the Presedent of UAE approved federal Law No.10 of 2017 on support service workers. the law also known as Domestic Labour Law offers protection to workers.
